Terms of Use – ClickToPay Education Payments (Clicktopay Legal name is Recharge API Services)

Welcome to ClickToPay Education Payments, a service provided by ClickToPay ("ClickToPay", "we", "us", or "our"). These Terms of Use ("Terms") govern your access to and use of the ClickToPay platform solely for the purpose of making credit card payments for education fees, tuition, and other approved educational expenses (the "Education Payment Services"). By using the Education Payment Services, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use the Education Payment Services.
1. Our Role
- ClickToPay is a technology platform that facilitates credit card payments from users ("Payers") to educational institutions and other approved beneficiaries ("Educational Beneficiaries"). We do not provide banking, lending, credit underwriting, financial advisory, or educational services. Our role is strictly that of a payment facilitator.
- When you initiate a payment through the Education Payment Services, you confirm that:
- You are making the payment for a genuine educational expense (tuition, examination fee, admission fee, hostel fee, etc.) owed to a legitimate educational institution or service provider.
- You have a valid, bona fide relationship with the Educational Beneficiary.
- All information you provide (including student ID, institution name, and payment details) is accurate and complete.
- ClickToPay does not verify or validate the authenticity of your relationship with the Educational Beneficiary, nor does it investigate the accuracy of the transaction amount. You remain solely responsible for ensuring that the payment is lawful and correctly directed.
2. Definitions
- Platform – The ClickToPay mobile app, website, and associated interfaces through which the Education Payment Services are accessed.
- User / You / Payer – The individual (student, parent, guardian) who uses the Platform to initiate an education payment.
- Educational Beneficiary – The educational institution, coaching centre, university, or other approved entity that receives the payment.
- Transaction – Any payment instruction initiated through the Platform for an educational expense.
- Third-Party Service Providers – External entities engaged by ClickToPay to facilitate payments, verification, authentication, or compliance (e.g., payment gateways, KYC agencies).
3. Eligibility
By registering for and using the Education Payment Services, you represent and warrant that:
- You are at least 18 years of age and legally competent to enter into binding contracts.
- You are not barred under applicable laws from using the Platform.
- You authorize ClickToPay to collect and verify your KYC details (PAN, Aadhaar, etc.) as required under applicable laws.
- You are responsible for maintaining the accuracy and confidentiality of your account information.
- If you permit another person to use your account, you remain fully liable for their actions.
4. Acceptable Use Policy
You agree not to use the Education Payment Services for any unlawful or prohibited activity, including but not limited to:
- Making payments for fictitious or unverifiable educational expenses.
- Using the Platform to launder money or engage in any fraudulent activity.
- Providing false, misleading, or incomplete information.
- Attempting to circumvent ClickToPay's security or verification measures.
- Using the Platform in any manner that violates applicable laws or regulations.
ClickToPay reserves the right to suspend, restrict, or terminate your account immediately if it suspects misuse or non-compliance.
5. KYC and Verification
- To comply with RBI, NPCI, and other regulatory requirements, ClickToPay may require you and/or the Educational Beneficiary to provide KYC documentation, including but not limited to PAN, Aadhaar, proof of identity, proof of address, or institutional credentials.
- You are responsible for the accuracy and authenticity of all documents you provide. ClickToPay may reject or suspend any transaction if the required documents are invalid, incomplete, or unverifiable.
6. Authorization and Payment Processing
By initiating a Transaction, you authorize ClickToPay to:
- Debit your designated credit card (or other permitted payment method).
- Route the funds (after deducting applicable fees and charges) to the bank account of the Educational Beneficiary.
- Share necessary transaction information with banks, payment gateways, and compliance authorities.
If a Transaction fails (e.g., due to incorrect beneficiary details, technical error, or insufficient funds), ClickToPay will refund the amount (after deducting applicable gateway charges and taxes) to your source account in accordance with our Cancellation and Refund Policy.
7. Transaction Terms
- Accuracy: You are solely responsible for ensuring the correctness of all details you enter, including the Educational Beneficiary's name, bank account number, IFSC code, and any student or invoice reference.
- Misdirected Payments: ClickToPay is not liable for payments misdirected due to your error. If you realise an error, you must contact us immediately; we will attempt to assist, but cannot guarantee recovery.
- Fraudulent Activity: If a Transaction is found to be fraudulent or unauthorised due to your negligence (e.g., sharing credentials), you bear responsibility. ClickToPay may block your account and report the matter to authorities.
- Suspension or Cancellation: ClickToPay may delay, suspend, or cancel any Transaction if it suspects fraud, security threats, or regulatory violations.
8. Fees and Charges
- Transaction Fee: ClickToPay charges a convenience / service fee per Transaction. The applicable fee is disclosed at the time of payment and may vary based on the payment category or promotional offers.
- Third-Party Charges: Any additional fees imposed by your card issuer, bank, or payment network (e.g., currency conversion fees, interest) shall be borne by you.
- Fee Revisions: ClickToPay reserves the right to revise its fees with prior notice via in-app or email communication. Continued use of the Education Payment Services after the effective date of revised fees constitutes your acceptance.
9. Rewards and Cashback
ClickToPay may offer cashback or reward programs for eligible education payment Transactions. Such offers are governed by the specific terms displayed within the app at the time of the offer.
- Eligibility: Only Transactions meeting the stated criteria qualify.
- Disbursal: Cashback will be credited as per the campaign terms.
- Modification: ClickToPay may modify, withdraw, or discontinue any reward program at its sole discretion without prior notice.
- Reversal: Cashback credited erroneously or resulting from invalid Transactions may be reversed without notice.
10. Tax Compliance
- You are solely responsible for complying with all applicable tax laws, including but not limited to the deduction and deposit of Tax Deducted at Source (TDS) on payments made to Educational Beneficiaries, if required.
- ClickToPay does not compute, deduct, or remit TDS on your behalf. Any liability, penalty, or consequence arising from non-compliance with tax obligations rests entirely with you.
11. Refunds and Chargebacks
- Refunds: If a Transaction fails before funds are settled to the Educational Beneficiary, the amount (minus applicable gateway charges and taxes) will be refunded to your source account. Refunds are processed in accordance with the ClickToPay Cancellation and Refund Policy.
- No Refund After Settlement: Once the funds have been successfully credited to the Educational Beneficiary's account, ClickToPay will not process a refund. Any refund arrangement must be made directly between you and the Educational Beneficiary.
- Chargebacks: If you dispute a Transaction with your card issuer and a chargeback is initiated, you agree to cooperate with ClickToPay in the investigation. If the chargeback is successful, the Educational Beneficiary will be liable to reimburse ClickToPay for the amount and any associated penalties. Failure to cooperate may result in suspension of your account.
12. Wrongful or Excess Credits
In the event that funds are wrongfully credited to your account or an Educational Beneficiary's account (e.g., due to a technical error or duplicate payment), ClickToPay reserves the right to:
- Reverse or recover such excess or wrongful amounts without your consent; and
- Suspend or place future payments on hold until the recovery is completed.
You agree that any wrongful credit does not create a valid claim in your favour and you will cooperate fully in facilitating the reversal or recovery.
13. Limitation of Liability
To the maximum extent permitted by law:
- ClickToPay shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the Education Payment Services.
- ClickToPay is not responsible for disputes between you and any Educational Beneficiary, nor for errors caused by inaccurate information you provide.
- ClickToPay's aggregate liability arising out of or related to these Terms shall not exceed the total fees paid by you for the disputed Transaction.
14. Force Majeure
ClickToPay shall not be held liable for any delay or failure to perform its obligations due to causes beyond its reasonable control, including but not limited to natural disasters, government actions, cyberattacks, network outages, or failures of third-party service providers.
15. Termination of Access
- ClickToPay may, at its sole discretion, suspend or terminate your access to the Education Payment Services without notice if:
- You breach these Terms.
- You engage in fraudulent, illegal, or abusive activity.
- Required by law or regulatory directive.
- There are security concerns.
- Upon termination, any pending Transactions may be cancelled and any refunds (if applicable) processed in accordance with the Cancellation and Refund Policy.
16. Governing Law and Dispute Resolution
These Terms are governed by the laws of India.
- Arbitration: Any dispute arising out of or relating to these Terms shall be settled by a sole arbitrator appointed under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Bengaluru, India. The language of the arbitration shall be English.
- Jurisdiction: Subject to the arbitration provision, the courts of Bengaluru shall have exclusive jurisdiction.
17. Indemnity
You agree to indemnify and hold harmless ClickToPay, its directors, employees, and affiliates from any loss, claim, penalty, or damage arising out of or related to:
- Your misuse of the Education Payment Services.
- Provision of false or inaccurate information.
- Your non-compliance with applicable laws, including tax obligations.
- Any dispute between you and an Educational Beneficiary.
18. Waiver of Rights
To the fullest extent permitted by law, you waive any claims against ClickToPay for loss or liability arising from:
- Unauthorised access or misuse of your data, except where caused by ClickToPay's gross negligence.
- Disputes with Educational Beneficiaries or third parties.
- Errors in transaction details entered by you.
19. Modification of Terms
ClickToPay reserves the right to modify, amend, or replace these Terms at any time without prior notice. Any changes will be published on the Platform, and the "Last Updated" date will be revised. Your continued use of the Education Payment Services after the effective date constitutes acceptance of the modified Terms.

21. Acceptance
By using the ClickToPay Education Payment Services, you acknowledge that you have read, understood, and agreed to these Terms of Use. If you do not agree, you must discontinue use of the Education Payment Services immediately.
